NEW INFORMATION........ 
AnMed and 31 (+/-) other South Carolina Hospitals recently attempted to sue Michael O. Leavitt, Secretary of the United States Department of Health and Human Services; and Kerry Weems, Acting Administrator of the Centers for Medicare and Medicaid Services in the United States District Court for the District of South Carolina, Anderson Division, Case No. 8:08-2453-HFF.  The hospitals alleged that among other things, CMS (Centers for Medicare & Medicaid Services) have "unlawfully recouped alleged Medicare overpayments", and that in "February, 2008, CMS, acting on determinations made by HealthDataInsights, Inc. ("HDI"), a Recovery Audit Contractor, sent notice letters to Medicare providers throughout South Carolina, including the Plaintiffs, most of which stated that CMS had determined that the hospitals had or should have had knowledge that certain services "were not medically necessary and reasonable," that the hospitals had billed for those services incorrectly......"
The complaint goes on to say that "Plaintiffs have appealed CMS's overpayment determinations.  Nevertheless, without any statutory authority, CMS recouped approximately $30,000,000.00 from hospitals in South Carolina for alleged overpayments".
The result:  On April 1, 2009, the case was dismissed due to lack of jurisdiction by the Court.
Ouch!  I wonder how they're going to recoup their legal fees.  Double check your next bill. 
Note:  In all fairness to the hospitals, it was a very wordy document and there are some issues that the hospital rightfully challenged such as deadlines, etc., but $30,000,000.00 isn't just one or two typos!
